These Terms govern your purchase and use of services provided by Tellus Consulting LLC.

1. Agreement to these Terms

These Terms of Service ("Terms") govern your purchase and use of services provided by Tellus Consulting LLC ("Tellus," "we," "us," or "our") through tellusai.com and related services.

By purchasing, accessing, or using our services, you agree to these Terms.

2. Services

Tellus may provide services including:

  • Certification preparation and training
  • Study guides and learning materials
  • AI-assisted learning tools
  • Practice resources
  • Partner portal access
  • Certification examination access or related assistance, when specifically included in a purchased plan
  • Technical and customer support
  • Other educational or professional-development services described on the applicable product page

The exact services included in your purchase are determined by the description displayed at the time of purchase.

3. Accounts and customer information

You must provide accurate information when purchasing or registering for our services.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You may not create accounts using false identities or provide access to your account to unauthorized users.

4. Third-party partner portals

Certain plans may include access to a third-party partner portal. Where applicable, Tellus may provide you with an invitation link or instructions for creating a partner portal account.

By accepting an invitation and registering with a third-party partner portal, you may also become subject to the terms, privacy policies, eligibility requirements, and other policies of the third-party provider.

Tellus does not control third-party platforms and cannot guarantee their continuous availability or functionality.

5. Certification services and outcomes

Tellus may provide preparation, training, study resources, and access assistance relating to third-party certifications.

Unless expressly stated otherwise, certification examinations and certifications themselves are administered or awarded by the applicable certification provider rather than Tellus.

Purchase of a Tellus service does not guarantee:

  • Passing an examination
  • Receiving a certification
  • Achieving a particular examination score
  • Employment, promotion, income, or other professional outcomes

Customers remain responsible for preparing for and successfully completing applicable certification requirements.

6. Pricing and payments

Prices are displayed on the applicable product or checkout page.

Payments may be processed through Stripe or another authorized payment processor. By submitting payment information, you authorize us and our payment processor to charge the applicable amount.

Where taxes are legally required, applicable taxes may be included in or added to the purchase price depending on the pricing terms shown at checkout.

7. One-time purchases and access periods

A one-time purchase provides access for the duration stated on the applicable product page.

For example, Tellus may offer fixed-duration access plans such as one-month or three-month training access.

Access expires at the end of the purchased period unless another plan is purchased.

8. Subscriptions and renewal

If you purchase a recurring subscription, your subscription will automatically renew at the frequency stated during checkout until canceled.

You authorize the payment method on file to be charged automatically for each renewal period.

You may cancel your subscription at any time. Cancellation prevents future renewal charges but ordinarily does not result in a prorated refund for a billing period that has already begun.

9. Refunds

Refunds are governed by our separate Refund & Cancellation Policy.

In general, a customer may request a refund within 7 days of purchase if the customer has not accepted the partner portal invitation link and signed up for the partner portal.

Once the customer accepts the invitation and registers for the partner portal, the service is considered activated and the purchase will generally become non-refundable, except where otherwise required by applicable law.

10. Permitted use

Tellus training materials and services are provided for your personal or internal professional use.

Unless expressly authorized in writing, you may not:

  • Resell our materials
  • Redistribute training content
  • Share paid account access with other individuals
  • Publish or publicly reproduce proprietary Tellus materials
  • Copy substantial portions of our training materials
  • Circumvent access controls
  • Use our services for unlawful purposes

Each paid account or access entitlement is intended for the individual customer for whom it was purchased unless otherwise stated.

11. Intellectual property

Tellus owns or licenses the content, materials, website elements, training resources, software, graphics, and other intellectual property provided through our services, except for third-party materials and trademarks.

Purchasing a service gives you a limited right to use the applicable materials. It does not transfer ownership of Tellus intellectual property to you.

Third-party company names, certification names, product names, logos, and trademarks remain the property of their respective owners.

12. Third-party services

Our services may depend on third-party platforms, payment processors, AI providers, certification providers, cloud services, or other vendors.

Tellus is not responsible for outages, policy changes, account restrictions, discontinued services, or other circumstances caused by third-party providers beyond our reasonable control.

If a third-party provider materially changes or discontinues a service included in a Tellus offering, we may modify the affected service or provide a reasonable alternative where feasible.

13. Service changes

We may improve, modify, replace, or discontinue portions of our services.

Changes will not intentionally deprive customers of material services already purchased without reasonable justification or an appropriate alternative.

14. Suspension and termination

We may suspend or terminate access if a customer:

  • Violates these Terms
  • Shares unauthorized access
  • Uses the service fraudulently
  • Attempts to circumvent technical restrictions
  • Engages in abusive or unlawful conduct
  • Initiates fraudulent payment activity

Termination for violation of these Terms may result in loss of access without a refund where permitted by law.

15. Disclaimer

Our services are provided on an "as available" basis.

We make reasonable efforts to provide accurate and useful training materials, but we do not guarantee that all information will remain current, error-free, uninterrupted, or sufficient to achieve a particular certification outcome.

Certification providers may change examinations, requirements, platforms, policies, or training objectives at any time.

16. Limitation of liability

To the maximum extent permitted by applicable law, Tellus Consulting LLC will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the services.

To the extent permitted by law, Tellus's aggregate liability relating to a purchased service will not exceed the amount you paid Tellus for that service during the applicable purchase or subscription period.

Nothing in these Terms limits rights or liabilities that cannot legally be excluded.

17. Governing law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.
